The Xpoint® concept, system (including the data systems and operations that comprise this website) & playing formats in conducting sporting competitions is the intellectual property of Xpoint Sports Systems Pty Ltd. (“Xpoint”) and may not be reproduced, copied or imitated in any way whatsoever without the prior written consent of Xpoint. The written rules, supporting documentation, marketing collateral, including information appearing electronically on this website that depict the aforementioned intellectual property is copyright and may not be reproduced, copied or imitated in any way whatsoever without the prior written consent of Xpoint.

The Xpoint® logo and concept, IPR™ logo and methodology, other trademarks, the Reward Store, Xpoint® formats, marketing and operating systems are the property of Xpoint. No trademarks may be reproduced or imitated in any way without the prior written consent of Xpoint. The Xpoint® system does not guarantee you income. Results will be determined by your ability to implement the system and tools provided for use

Players may be awarded Xpoint® reward points upon participation and/or successfully winning and runner-up results when competing in Xpoint® competitions. The awarding of and the level of those award points is at Xpoint’s complete discretion. Xpoint® reward points may only be used to redeem for those items currently displayed at the Rewards Store (rewards.xpointsports.com). The use of reward points is governed by the following terms:

• All payments made by credit card via the Rewards Store will appear on your credit card statement as "Xpoint Sports";
• You may choose to contribute a portion of rewards points and pay the balance with a valid credit card, but you must contribute the minimum points as stipulated;
• Rewards Store points are not redeemable for cash;
• Rewards Store points may not be transferred to another player account, unless merging the player accounts of the same person;
• Your points will expire 36 months from the date they are credited to your player account, unless otherwise notified to you by Xpoint at any time;
• Xpoint does not guarantee the continuous supply of any product or service advertised in the Rewards Store;
• If a product you order is not available then Xpoint may substitute it with a similar product;
• The estimated delivery time for all orders is four to six weeks from the order date. Xpoint is not liable for any delays beyond that time frame;
• Neither this web site or Xpoint are responsible for any loss suffered due to non-supply of any product and/or service

The Xpoint® website allows you to display content on your player profile page, and post publicly viewable comments on other Xpoint® players’ player profile page. Your publicly displayed player profile page may not include any of the following items: telephone numbers, email addresses, street addresses, lewd, obscene, derogatory, violent, racist, discriminatory, or harassing language, and any photographs containing nudity, or obscene, lewd, excessively violent, harassing, sexually explicit or otherwise objectionable subject matter, or an image of a person you have not gained permission from to post their image on the site. Or content that:

• Solicits any personal information from a person under 18 years of age;
• Contains any external link or reference to another website outside of this one;
• Contains any email address;
• Promotes information that you know to be false, misleading or illegal or promotes any illegal activity;
• Advertises or promotes any alcoholic or gambling related products;
• Advertises any commercial activity, products or services;
• Attempts to impersonate another person

Despite this prohibition, other players’ profiles may contain inaccurate, inappropriate, offensive or sexually explicit material, products or services, and Xpoint assumes no responsibility or liability for this material. If you become aware of misuse of this site by any person, please contact us here. Xpoint reserves the right, at its sole and absolute discretion, to reject, refuse to post or remove any posting by you, or to restrict, suspend, or terminate your access to all or any part of the website services at any time, for any or no reason, with or without prior notice, and without liability. Xpoint may also choose to remove you as a competing player in an Xpoint® event at any time if it, at its sole discretion, believes you have violated any part of these terms, or for any other reason as the Xpoint® rules provide from time to time.

When you sign up for an Xpoint® account you will choose a password for your account. You are entirely responsible for maintaining the confidentiality of your password. You agree not to use the account, username, or password of another Xpoint player at any time and to not disclose your password to any third party. You agree to notify Xpoint immediately if you suspect any unauthorized use of your account or access to your password. You are solely responsible for any and all use of your account.

Xpoint is committed to your privacy. When you visit this web site we will only collect individually identifiable information about you when you voluntarily provide us with that information. It is a requirement of entry in Xpoint® competitions that this information is provided upon request. It is a condition of entry to any Xpoint® competition that we be allowed to send you emails for so long as your account remains active. Otherwise we will only collect statistical information about your visit to the web site. Any personal information you provide to Xpoint will be kept confidential and only used to further support your relationship with Xpoint. Any information you provide to Xpoint will not be passed onto a third party, unless you have given Xpoint consent for this to occur. Agents or contractors of Xpoint who, from time-to-time have access to your personal information, are required to keep this information confidential and not use it for a purpose other than carrying out the service they are performing for and on behalf of Xpoint. Should you not wish to receive information from us or wish to change or update your personal information simply notify us here and we will satisfy all such requests as quickly as possible.

Unless otherwise indicated, Xpoint owns the copyright to any information, concepts, formats, graphics and pictures contained on this site, other than that appearing on player profile pages. No part of this web site may be reproduced, copied, imitated or distributed in any way (except where it is for private, personal use) without the prior written consent of Xpoint unless that information has been provided with the purpose and intent to the contrary. Written requests to reproduce any part of this web site can be directed to us here. All pictures used are the property of Xpoint, or are used by Xpoint under license by another provider. However, Xpoint and the Xpoint Co-ordinators do not warrant that competition (the product/service) descriptions or other content of this site is accurate, complete, reliable, current, or error-free. In the case of any protest relating to scoring and match results, Xpoint, or its appointed representative, shall have the final determination and no correspondence will be entered into.

You are free to link another site to this site so long as you do not imply any sponsorship by Xpoint of your site (unless permission is given by Xpoint to the contrary). You may only display an Xpoint® trademark (including the Xpoint® logo) on your web site if Xpoint expressly gives you permission to do so. In any case, the trademark must only be displayed in the form provided by Xpoint and may not be changed or manipulated in any way. The trademark must be displayed in the exact dimensions as provided and may not be altered. You may not re-use any trademark that you take a copy of from this website. This web site, the information it contains and the products and/or services offered should only ever be considered as displayed and/or provided in the state of New South Wales, Australia.

All payments are made via 128bit SSL technology to ensure the security of your personal and credit card data.

Payments made via this site are for products and servies as diaplyed in the Xpoint rewards shop. Xpoint rewards point must be used to redeem for products, however you may choose to contribute a portion of the value via a credit card payment. This contribution can only be to the maximum value allowed by the "points + pay" calculator contained within each product description. Please allow 4-6 weeks for delivery. Products found to be defective upon receipt will be replaced. Products may be returned within ten (10) days of receipt for any reason (a AU$30 administration charge will be applied) so long as the goods are in their original unused, undamaged or unwashed condition.
